These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Whitecapps, LLC, a Delaware limited liability company, doing business as Gabriel (“Company,” “Gabriel,” “we,” “us,” or “our”), governing access to and use of the Gabriel website, mobile applications, desktop supervision utilities, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms.

1. Eligibility
Accounts may only be created by individuals aged 18 years or older. Accounts are intended for parents or legal guardians managing devices used by minors. No accounts may be created directly by children.

2. Description of Services
Gabriel provides digital device management tools including integration with Apple Screen Time APIs, Apple device supervision and MDM-based configuration tools, app blocking, website restriction, scheduled usage enforcement, parent-controlled profile switching, mobile apps, desktop utility, web dashboard, and enterprise, school, or parish management. Gabriel does not access message, browsing, email, photo, file, or other personal content.

3. Subscription, Billing & Payments
Payments are processed by Stripe and require accepting their policies. Gabriel offers monthly and annual subscriptions, a 7-day free trial, and a 30-day refund guarantee. Subscriptions auto-renew unless canceled. Cancellations can be made in your account settings.

4. Enterprise Plans
Separate written agreements may apply for enterprise, school, and parish users. If they conflict with these Terms, the written agreement controls.

Affiliate, User Responsibilities, and Content

5. Affiliate & Referral Programs
Referral or affiliate programs are offered subject to separate terms, abuse or fraud may lead to termination.

6. User Responsibilities
You must provide accurate information, safeguard credentials, ensure legal device authority, not use for unlawful purposes, and not reverse engineer or interfere with the Services. You are responsible for local legal compliance.

7. No Content Monitoring
Gabriel does not read messages, access email content, monitor private communications, view photos or files, or capture browsing content.

8. Intellectual Property
All software and content are owned by Whitecapps, LLC, protected by law. No license granted except as expressly provided.

9. Export Compliance
Gabriel may use encryption subject to U.S. export laws. Users are responsible for complying with export regulations.

Disclaimers, Liability Limits, Indemnification

10. Disclaimer of Warranties
Services are provided “as is” and “as available.” Gabriel disclaims all warranties, express or implied, and does not guarantee uninterrupted service or behavioral outcomes.

11. Limitation of Liability
To the maximum extent permitted by law: Total liability will not exceed fees paid during the last 12 months. Gabriel is not liable for indirect, incidental, special, consequential, or punitive damages.

12. Indemnification
You agree to indemnify and hold harmless Whitecapps, LLC for claims arising from misuse of the Services, violation of law, or violation of these Terms.

13. Force Majeure
Whitecapps, LLC is not liable for delays or failures due to events beyond its control.

Disputes, Termination, and App Stores

14. Dispute Resolution & Arbitration
These Terms are governed by Minnesota law. Disputes will be resolved by arbitration in Minneapolis, MN. Claims must be individual; class actions are waived. Small claims court is available for eligible cases.

15. Termination
Gabriel may suspend or terminate your account for Terms violations. Users may terminate their account at any time.

16. App Store Compliance
For Apple App Store: These Terms are between you and Whitecapps, LLC, not Apple. Apple is not responsible for the Services and has no obligation to provide support. Apple is a third-party beneficiary. For Google Play: These Terms are between you and Whitecapps, LLC, not Google. Google provides no support. Google is a third-party beneficiary.

Changes to Terms

17. Changes to Terms
Updated Terms will be posted with revised dates. Continued use of Gabriel Services constitutes acceptance.
